Federal Judge Mandates Release of Abrego Garcia from Immigration Detention
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without legal authority.
"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.
The case originates in a mistaken removal to El Salvador in March, which the government later acknowledged was an mistake. Following his repatriation to the United States to answer alien smuggling charges, he was detained in immigration custody.
In her decision, the court pointed out that the authorities does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

The legal proceedings involve conflicting assertions. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.
